The Supreme Court has ruled that the ICJ cannot over rule DOMESTIC law; interestedly ICJ rulings have never been used to overrule domestic law ANYWERE. But genocide is illegal under US law so the ICJ ruling about it would be enforced domestically.
What the ruling means is that it explicitly lays out the constitutional law regarding International Treaties., and made the point obviously, is that the President has signed an INTERANTIONAL treaty, and the Congress has empowered the President (automatically when the president is made president), whoever the President may be with the power to sign and be politically RESPNONSIBLE to the ICJ/UN for these international treaties. If any country, Russia (pure chance) committed genocide in another, say Belgium, they would be tried by the ICJ court…the same would apply to the US. These international treaties, see previous posts, cannot be changed by congress, the US is signed to the total UN genocide convention, and they have no opt-outs, see previous posts, they cannot have opt-outs. The Ruling proves that ICJ rulings are supreme internationally, that the US can be held to account by the ICJ for US actions. The Supreme Court Ruling has enshrined the supreme nature of International treaties in US Constitutional law….the argument is over period.
It doesn’t matter what a philosopher said twenty years ago, or what a lawyer wrote 17 years ago (though you do not understand Le Blanc’s point, no doubt because it did not agree with your bigotry) the face is that the highest court in the US has enshrined the responsibilities of the US internationally to the ICJ/UN in US law.
Now let’s look at things clearly.
1) The Genocide convention is signed by the US. • check.
2) It needs to be ratified by the US Congress • it was.
3) That congress cannot alter the UN treaty in any respect, see previous posts • correct.
4) The UN genocide convention needs to become part of US domestic law • it was, with stronger punishment than the UN -yup genocide is illegal under domestic US law.
5) That the UN Charter requires that genocide suspects have to be extradited to face justice in UN mandated courts • the US does extradite genocide suspects, even US citizens to face trial at ICJ courts • again like the UN convention states. The US has never refused a genocide extradition to a UN court. So that’s OK.
6) The US is offering millions of $ in rewards trying to find UN wanted genocide suspects in the US, even though that is not in the UN convention • yes.
7) That the US president is responsible to the UN and the ICJ for its INTERNATIONAL TREATIES for US actions, in this case any acts of genocide • yes indeedey. Indeed the people who control the US Constitution have made a ruling, see previous post; a LEGALLY BINDING RULING that this is the case….this is US constitutional law. THAT THE US IS ANSWERABLE TO THE ICJ/UN FOR ANY CRIMES OF GENOCIDE. There are no ifs or buts here. The President or the Congress cannot refuse to comply as the US is obligated to its international treaties.
Now let us return to your original ridiculous contention – Genocide is LEGAL in the US… it is not, obviously, it is illegal under domestic law, it is illegal under international law, and that the US, through its President is answerable to the ICJ/UN for any accusations of genocide. Why do you babble? Russia withdrew its reservation to article IX. The US did not. You have demonstrated nothing in your babbling, except that you avoid the issue, and the recent world court judgement citing article IX when Serbia tried to take NATO to the ICJ.
